In Texas, fake IDs are most prevalent among college students who are looking to get into bars. Despite emerging technologies that are designed to prevent identification fraud, college students continue to find ways to acquire or create fake IDs. Although having or using a fake ID is generally viewed as a victimless crime, the penalties for this seemingly minor offense can be significant. In this blog, we explain fake ID laws in the state of Texas. According to The Texas Transportation Code §521.451, a minor who is in possession of a fake ID can be charged with a Class A Misdemeanor. This is punishable by up to 365 days in jail or fines that can cost up to $4,000. Under the Texas Alcoholic Beverage Code §106.07, a minor who tries to buy alcohol with a document that indicates they are 21 or older, can be charged with a Class C Misdemeanor. A minor who is caught breaking this law can be punished with a $500 fine, alcohol awareness classes, community service, and suspension of their license. Texas Penal Code §37.10 contains serious punishments for minors who tamper with a governmental record. A person charged under this law faces punishments that range from Class C Misdemeanor to a 2nd Degree Felony.
