Punishments for Underage Drinking
Purchase of Alcohol by a Minor: Class C Misdemeanor, unless the minor is under the supervision of police
enforcing the Alcoholic Beverage Code.
Attempt to Purchase Alcohol by a Minor: Class C misdemeanor, purchase must be made with specific intent beyond
Misrepresentation of Age by a Minor: Class C Misdemeanor
Possession of Alcohol by a Minor: Class C Misdemeanor, except if the minor is in the presence of an adult
parent, guardian, or spouse. Minors under the supervision of an officer
enforcing the Alcoholic Beverage Code are also exempt from this.
Consumption of Alcohol by a Minor: Class C Misdemeanor, unless the minor is in the visible presence of an
adult parent, guardian, or spouse.
All of the above violations are punishable by a fine of up to $500, mandatory
alcohol awareness courses, 8 to 40 hours of community service, and revocation
or denial of driver’s license. Minors who have a third underage
drinking charge face fines that cost up to $2,000 and/or 180 days in jail
and automatic driver’s license suspension.
